This privacy statement describes what personal data of individuals (except for personal data of EuroCCP employees and members of its statutory bodies) is collected by European Central Counterparty N.V. (hereinafter “EuroCCP”) and the purposes for which the personal data is used.
EuroCCP reserves the right to make changes to this Privacy Statement from time to time. Changes to the statement are effective immediately upon publication on the EuroCCP website.
EuroCCP processes personal data as a “controller” as defined under article 4(7) of the General Data Protection Regulation (GDPR) of the European Union, and in accordance with the principles of GDPR. EuroCCP processes personal data for the purposes of its legitimate interests as a Central Counterparty authorised under the European Market Infrastructure Regulation (EMIR), and to meet its legal and regulatory obligations.
Personal Data refers to information that can directly or indirectly identify an individual, for example name, address, identification number, telephone number, email address, location data (URL) or IP address.
EuroCCP processes personal data collected indirectly when:
- performing due diligence on users of its services;
- collecting and maintaining contact details required for the provision of its services;
- performing due diligence on suppliers or providers of services to EuroCCP;
Whereas when someone visits the EuroCCP website (although no registration is required) personal data is collected directly. The webserver automatically records the internet protocol (IP)-address of the user, the name of the previous website from which the user accesses this website (e.g. google), and the specific pages of this website viewed including the date and length of visit.
All personal data handled by EuroCCP is processed securely and with due care. EuroCCP maintains appropriate administrative and physical safety and security measures to protect personal data, and in the event that personal data is to be transmitted to a location outside of the EEA, such a transmission will only be made in accordance with the requirements of GDPR Chapter V to safeguard the rights of data subjects.
EuroCCP retains personal data in alignment with its regulatory recordkeeping obligations.
EuroCCP does not process personal data by means of automated decision-making.
Data Subject Rights
You have the right to request information on which personal data relating to you has been stored, how the data was collected, for what purpose and with whom it is shared.
You have the right to view your data, and if incorrect or incomplete insist the data is amended.
You have the right to request your personal data is deleted if the processing of such data has no legal basis or if the legal basis has ceased to apply, or the purpose for processing has lapsed or ceased to be applicable for other reasons. Note, EuroCCP will not be able to delete your personal data if such an action would disregard any EuroCCP legal or regulatory obligation.
You have the right to be informed of the safeguards in the event your personal data is transferred to a non-EEA country or international organisation.
